Jonathan Underhill’s client acquitted of attempted murder

3PB Barristers’ (3 Paper Buildings) specialist criminal law barrister Jonathan Underhill has successfully secured an acquittal for his client, accused of attempted murder.
Following a week-long trial, Jonathan’s client, W, was acquitted of attempted murder. W had attended at a school car park in possession of, what was described by the prosecution as, a “vicious cut-throat razor”. W approached his ex-partner, whom he knew would be in attendance, and following a confrontation slashed the victim’s throat. The entire incident was captured on CCTV. The prosecution adduced significant evidence of both the build-up to the blow and its aftermath, including consistently damaging comments made by W immediately following the attack.
The case required careful and targeted cross-examination and relied heavily on Jonathan’s closing submissions to the jury as to the extent to which the prosecution could prove W’s state of mind at the time of the attack, notwithstanding the significantly persuasive evidence adduced in support of the prosecution’s case.
