Insolvency Law Update - Birmingham

You are invited to 3PB’s insolvency case law update hosted by Cheryl Jones, Rebecca Farrell and Aaron Luxton, which we will be hosting in our Birmingham office on Thursday 12th September.

Our panel members will discuss recent significant decisions so far from 2024. This seminar will principally be useful for those specialising in insolvency and company disputes. However, analysis of the appeal heard by the Supreme Court on Section 423 IA 1986 (judgment awaited) has wider implications for commercial practitioners concerned with asset recovery.

Topics include:

• Office holder remuneration – the ability to seek additional remuneration after vacation of office and tips for applications of this nature
• Bankruptcy petitions – the use of foreign judgments in bankruptcy petitions and associated issues
• Funding – litigation funding agreement based on a multiple of the funding provided in the spotlight post R (on the application of PACCAR Inc and others) (Appellants) v Competition Appeal Tribunal and others (Respondents) [2023] UKSC 28
• Transactions defrauding creditors / relief under S423 IA 186 – reflections on the issues the Supreme Court heard in El-Husseiny v Invest Bank PSC
• Bounce Back loan schemes – advising office holders and directors where loans remain unpaid in an insolvency event
