RegisterWhat role is left for Judicial Review on the basis of appeals or potential appeals where there is an EHC Plan.
There have been a number of High Court injunctions, or permission granted in the Administrative Court, where appeals are either pending, about to commence involving children and young persons with EHC Plans. Some of these cases have involved Section 20 of the Children Act and its application of Section 19 of the 1996 Act. The seminar will consider if Judicial Review has been revived as a significant path of litigation for those with EHC Plans.
The seminar will be chaired by Lachlan Wilson and will include the following presentations from:
- John Friel, who will examine what role is left for Judicial Review on the basis of appeals or potential appeals where there is an EHC Plan
- and from Alice de Coverley, who will provide an update on the new statutory school exclusion guidance, in force since 1 September 2017.
