Andrew Duncan writes for The Barrister on risk identification in child welfare cases

3PB Barristers’ (3 Paper Buildings) specialist family law barrister Andrew Duncan (pictured here) has written for The Barrister on the importance of a proper identification of risk in cases involving child welfare evaluation.
In his article entitled “A timely reminder: Risk Identification and Mitigation”, Andrew uses reported case examples, such as H-W (Children); H-W (Children) (No 2) [2022] UKSC 17, as well as his own experience within the family courts, to explore the importance of thorough risk assessments by Local Authorities in order to avoid adjournments and/or delays due to further assessments being required.
Andrew also highlights the importance of practitioners making an early-stage identification of any inadequate pleading within threshold to ensure accurate assessments are completed so that the court can properly “conduct the holistic balancing exercise that the child’s future demands.”
