Tony Bingham criticises law on payment rules for contractors in construction projects

The article criticises the payment rules in the Construction Act, arguing that they are overly complex and full of legal technicalities that create pitfalls for contractors. It highlights the recent case of Placefirst Construction Ltd vs CAR Construction (North East) Ltd, decided in the Technology and Construction Court on 24 January, as an example of these complications.

The original intent of the Act was to ensure timely and fair payments through a straightforward process, but instead, it has become overly legalistic, allowing lawyers to exploit its intricacies. Anthony calls for industry-led reforms to simplify the system and make it more practical for construction professionals.
