3PB in Court of Appeal on employment tribunal decision

3PB Barristers' employment & discrimination law specialist Matthew Curtis appeared in the Court of Appeal on Tuesday 5 May 2020. Matthew was representing the Appellant in a hearing which went ahead despite the current lockdown since the pandemic. The representatives and Court of Appeal judges appeared via video link using Skype for Business, with the appellant choosing to dial in via telephone.
The Court of Appeal was asked to determine whether the Employment Tribunal had erred in its decision not to allow the Appellant an adjournment when it changed its view on the medical evidence it wanted for the hearing.
In the judgment, handed down today Friday 15 May, Matthew was complimented by Underhill LJ for his “excellent submissions before us”.
Matthew commented : “The facts of the case were complex and drawn out, so I assisted the Court of Appeal in ensuring it was taken through the specific issues which were to be addressed, focussing on the key points amongst a voluminous background. The Court of Appeal’s use of technology to allow the hearing to proceed was an excellent alternative to the case being postponed and allowed for justice to be prioritised and dealt with in a timely manner”.
