Damages claims against Universities and Schools

The seminar will cover claims in damages against universities and independent schools for breach of contract and in relation to claims under the Equality Act. These claims involve different considerations.  In recent years due to the increase in fees charged by universities, claims in damages by students have increased.  Few cases have gone to full hearings, but there have been a number of settlements, some of them reasonably substantial.

The relationships between students and universities is governed by the contract between students and universities, but obviously, in relation to the universities and schools, claims can be made in both contract and negligence.  Due to the withdrawal of Legal Aid whether a claim in negligence as opposed to a claim for a breach of contract is viable, is an issue that will be considered.

Equality Act claims against schools, the maintained and independent sector, remain infrequent but are significant if a claim is brought against a school.  However it should be borne in mind that a finding of discrimination in the Special Educational Needs and Disability Tribunal, will almost inevitably in the case of an independent school be capable of forming the basis of a claim in breach of contract.  In this regard Equality Act claims may have a more significant effect on not only a school’s reputation but also its public image.  Equality Act Claims against universities are in damages in the County Court.

Lachlan Wilson who has been involved in a large number of claims against universities, will lead the seminar.  On Equality Act issues John Friel and Charlotte Hadfield will jointly deliver a paper.  At each seminar we will provide either Case Law updates or dates upon significant developments bearing in mind there is legislation affecting education going through parliament at the present moment.
