Areas of specialisation
Education, employment and property. Practises in all areas of education and employment law. Represents individuals, employers, local authorities, schools, and charities. Particular experience in cases of discrimination (race, religion, sex (including equal pay), and disability), school admissions, school exclusions, special educational needs, educational negligence, and whistle-blowing. His property practice is principally concerned with neighbour-disputes (e.g. boundaries, easements and claims of adverse possession).
Lachlan's fitness to practice experience includes acting for registrants before the General Medical Council, the Nursing and Midwifery Council, the General Dental Council and the Health and Care Professions Council. Additionally he has acted as legal assessor for the General Osteopathic Council, and he continues to sit as legal assessor for the Nursing and Midwifery Council, a position which he has held for over two years.
As a legal assessor for the NMC he is experienced in advising the investigatory, conduct and competence, and health panels, and the parties before the panels, on the law and procedure available to them under the Council's regulations. Elsewhere, Lachlan has represented medical and other university students when issues have arisen bringing into question their suitability to continue their chosen vocational study. His education practice calls upon him to provide advice and statutory training for independent admissions and exclusions panels, and his large employment practice provides a bedrock of experience as to fairness and adequacy of procedure in the context of disciplinary and capability proceedings.
Synopsis - General
Lachlan’s years of trial advocacy and litigation experience have not been confined to employment, education, and neighbour disputes. Other areas of his practice have included consumer law, personal injury and landlord & tenant, and this range has served as a firm foundation to his civil practice, and has equipped him equally in the skills of trial advocacy, which he relishes, and the more jurisprudential advocacy before the Administrative/High Court.
Lachlan is now best known for his expertise and experience in the fields of education and employment. These complementary fields demand scrutiny and presentation of, often complex, issues of fact, within a legislative framework which comprises UK statute, European and Human Rights law. He is also a trained mediator, and his skills in, and support for, this alternative approach to dispute resolution, has often proved beneficial in his employment and neighbour-dispute cases.
Lachlan is recognised as a Leading Junior by Legal 500 2012/13 directory at the London Bar in education law, reflecting his wide expertise in this area of the law.
