Adam Feest QC leading Gemma White secure Manslaughter conviction in hit and run

6th June 2019

On 3rd June at Bristol Crown Court Dario Carboni changed his plea to guilty in respect of the manslaughter of pensioner Kenneth Kiley in July last year. This plea came at the close of the Prosecution case following complicated pre-trial legal argument and 10 days of evidence.

Despite denying being the driver of the vehicle involved in the fatal collision with Mr Kiley, and maintaining this throughout the trial, he finally accepted his responsibility once Adam and Gemma had presented all of the evidence to the jury. Mr Carboni had been in a residential area of Swindon on the evening of the 8th July 2018 and had initially collided with a car being driven by Mr Kiley's wife. When Mr Kiley got out of his car  to exchange insurance details he was fatally struck by the Corsa which was being driven by Mr Carboni,  despite the fact he was disqualified from driving.

As a result of his change of plea he was sentenced immediately  to 9 years imprisonment and disqualified from driving for 8 and a half years, with a requirement to do an extended retest before he is permitted to drive again.
