Thomas gained experience of the full gamut of personal injury and clinical negligence litigation. He appears for Claimants and Defendants in a wide array of personal injury actions arising out of the online portals and on the fast and small claims tracks. From interim applications through to trials and disposal hearings, he is comfortable conducting all aspects of proceedings.
In addition to his court work, Thomas accepts instructions to settle pleadings and advise on liability, quantum and procedural issues (both in writing and in conference).
- C v A Local Authority (fast track): Highway claim (C). Claimant stepped on a defective manhole cover and fell down the manhole, injuring herself. The local authority sought to amend its defence on the day of trial. Following Thomas’ successful opposition to this application, the Claimant received an extremely favourable settlement.
- D v I (MOJ portal): Road traffic accident (D). Legal argument on the cut-off point for uploading evidence onto the portal. Consideration of whether breach justified dismissal of the claim.
- X Ltd v Y Ltd (fast track): Road traffic accident (C). Motorway collision between two HGVs. Judge found 100% in the Claimant’s favour.
