Business & Commercial Law

Thomas represents Claimants and Defendants in matters proceeding on the fast and small claims tracks.  He conducts pre-trial hearings, interlocutory applications and trials.  He has a growing insolvency practice and has appeared in the Chancery Division.

In addition to his court-based practice, Thomas accepts instructions to settle pleadings and advise in writing.

 Recent Work

  • ABC Ltd v X (fast track): Debt recovery (D).  Thomas represented a client who was being sued by her former partner’s company for renovation work.  Following his robust opposition to the introduction of late evidence, the Claimant agreed to discontinue the action.
  •  X Plc v TT Ltd (small claims track): Debt recovery (C).  Following Thomas’ cross-examination of the Defendant’s sole director, the judge not only found in favour of Thomas’ client but also made a costs award against the Defendant, deeming its conduct unreasonable.
  •  XYZ Plv v RL Ltd: (small claims track): Penalty clauses and unfair contract terms (D).  In the face of Thomas’ submissions, the corporate claimant was unable to substantiate its case, which was dismissed in its entirety.
